Report into the use of NZS Contract Conditions

In response to growing concern in the infrastructure sector over the use of NZS Conditions of Contract in public sector-initiated projects, Treasury’s Infrastructure Transaction Unit (ITU) commissioned a review to be undertaken with industry leaders from major disciplines.

Urban Outcomes, in conjunction with Advisian, researched the issues, conducted interviews with industry stakeholders and composed the report which identified seven key challenges facing the industry, including the developing culture of mistrust in the sector, unreasonable risk transfer and increasing risk transfer by stealth. The report was used to inform the newly-formed New Zealand Infrastructure Commission, Te Waihanga, of opportunities for improvement for the public sector to contribute to a more sustainable construction industry in New Zealand.

This think piece has been released to the public and has become a catalyst for industry discussion, debate and ultimately, change.
